Sjiem Fat & Co. gave a presentation at the Hilton Aruba on labor matters in October 2016

In a legal climate where dismissing underperforming employees can be difficult and extremely costly to employers, proper documentation of incidents and a thorough personnel file will often be a deciding factor when a dismissal is challenged. To that end, Sjiem Fat & Co recently held a presentation for the managers and supervisors of the Hilton Aruba on dealing with underperforming employees from a legal perspective.

As the first to observe and identify unacceptable and improper behavior, the supervising staff and departmental managers must write up and report these offenses in a prudent and expedient manner. The employer relies on incident reports and considers other documentation gathered throughout the employment history, such as any complaints, previous warnings and statements to determine whether the offense under the circumstances constitutes an urgent reason for dismissal or justifies a different disciplinary measure. Building a file is thus essential in the evaluation and review employee’s performance.
